The “Terms of Use”, the provisions of which are written below, regulate the rules you must follow in order to benefit from our website with the extension www.walkersapp.com and the Walkers mobile application (the website and mobile application will hereinafter be referred to as the “Site”).

SIDES

The site is available to you at www.walkersapp.com – info@walkersapp.com (hereinafter referred to as “Walkers”) Walkers constitutes a party to these Terms of Use. The other side of the Terms of Use is our Users who benefit from the Site.

Throughout these Terms of Use, Walkers and Users will be referred to individually as “Party” and together as “Parties”.

Walkers has the right to transfer the Site or these Terms of Use to third parties. In such a case, you can continue to use the Site.

Walkers may unilaterally change, add to or renew these Terms and other terms of use published on the Site at any time, without giving any reason and without any notice, reorganize the Site, change or publish the subject, scope and content of the Site. The right to stop is reserved.

If any provision of the Terms of Use is deemed invalid by a competent judicial or administrative authority, it will be implemented between the parties with a new provision that most closely matches the purpose of the provision in question and will be legally valid.

RIGHTS AND LIABILITIES OF THE PARTIES

The person who wants to benefit from the services offered by Walkers cannot benefit from the services in question if he is under the age of 18, which is the legal age of majority. These persons are strictly prohibited from accessing the Site.

It is prohibited for traders, tradesmen or other legal entities to become members of Walkers through the Website, unless otherwise announced on the Website.

In order to benefit from the Site, the User must become a member of the Site using the methods offered by Walkers. The User cannot benefit from the Site in any way unless he becomes a member. However, Walkers may allow you to benefit from a part of the Site without requiring membership. The User will comply with the Site Terms and other provisions that may be published on the Site from time to time, the law, morality, etiquette and principles of honesty in all transactions he will carry out on the Site; They will not engage in any behavior that may hinder the operation of the Site by any means and will not engage in acts that infringe or may violate the rights of third parties.

Users take any action that may threaten the security of the Site, prevent the operation of the Site’s software or prevent other Users from benefiting from the Site, or impose a disproportionate load on the Site in a way that will produce these results; Unauthorized access to information and content published on the site and/or entered by others; Taking actions that may threaten the general security of the Site and/or harm the Site, Walkers and/or other Users; Using or attempting to use software that will prevent the operation of the Site and the software used, or disrupting the operation of all kinds of software, hardware and servers, causing them to malfunction, reverse engineering, organizing attacks, occupying or otherwise interfering and providing unlawful access to Walkers servers. Working is strictly prohibited.

PROVISIONS RELATING TO THE CONTENT ON THE SITE

Walkers reserves the right to change or remove the Services and content offered on the Site at any time; Adding, changing or removing content from the site; It has the authority to deny access to all or some persons to the information and content uploaded to the system by third parties, including users, and to change or remove such content. Walkers may exercise these rights without any notice or prior notice.

PROVISIONS RELATING TO THE OPERATION AND ACCESSIBILITY OF THE SITE

The User acknowledges that access and quality of the Site and the services offered through the Site are largely based on the quality of the service provided by the relevant internet service provider and that Walkers has no liability for problems arising from the quality of service in question, that the operation of the Site is not free from defects and that technical glitches or technical glitches may occur from time to time. The User also acknowledges that access to the Site may be suspended in whole or in part at any time and for any reason at Walkers’ discretion. In addition, Walkers has the right to permanently close the Site or cease its activities at any time.

If the User acts unlawfully or violates these Terms of Use while using the Site, Walkers has the right to partially or completely, temporarily or permanently prevent the User from using the Site. Walkers’ other legal rights are reserved.

Walkers has no liability towards users due to temporary suspension or complete cessation of services or closure of the site.

INTELLECTUAL PROPERTY RIGHTS

24.All rights on the software, visuals and designs, texts, logos, graphics and other products that may be subject to any intellectual and industrial rights on the site belong to Walkers. Using the Site or becoming a member of the Site or taking any action regarding the Site does not mean that any intellectual or industrial rights regarding the Site are transferred to the User.

Users cannot upload any content to the Site that may violate any intellectual or industrial rights. If the User violates this provision, the User will be responsible for all damages that may arise before Walkers or other third parties.

If the relevant intellectual or industrial right owner or his representative or any other third party notifies Walkers that the User is using this Site as a means of illegal infringement or violation of rights, or the violation is proven by a court decision or the relevant User’s admission, or Walkers If is in any way suspicious/concerned about the situation, the violating user may be prevented from accessing or using this site.

Copying the information and/or software used in the design, content and database creation of the Site and/or using it beyond benefiting from the Site, any images, text, images, files, etc. contained within the Site. Copying, distributing, processing and other use of data is strictly prohibited.

RESPONSIBILITIES OF THE PARTIES

All legal, administrative and criminal liability regarding the use of the site belongs to the User. Walkers cannot be held directly and/or indirectly responsible for any damages that third parties have suffered or may suffer as a result of the User’s activities on the Site and/or actions contrary to these Terms of Use and the law. Any claims from third parties in this context and any damages suffered by Walkers arising from the User’s failure to fulfill its obligations specified in the Terms of Use will be recourse to the User.

Walkers, accessing the Site, accessing the Site or the information on the Site, other data and programs, etc. is not responsible for any direct or indirect damages that may arise as a result of the use of the Site, especially the use of the Site, interruption of transactions carried out on the Site, and data loss. Walkers will not be liable for any direct, indirect, special, incidental or punitive damages arising from the use of the Site, including, but not limited to, loss of profits, loss of goodwill and reputation.

Walkers cannot be held responsible in any way for any material or moral damages that may occur as a result of errors or omissions in the information on the site or as a result of transactions made based on this information, and for any damages that third parties may suffer in any way.

OTHER PROVISIONS

Walkers has the right to monitor all non-personal data obtained through the Site and the traffic occurring on the Site (provided that it does not contain personal data) and to process the data within this scope as it wishes.

All notices, warnings and confirmations arising from these Terms of Use between the parties and objections thereto; It is made via telegram, fax, agreed upon e-mail addresses or through a notary (except for notifications that must be made in a certain manner in accordance with the law).

APPLICABLE LAW AND EVIDENCE AGREEMENT

In all disputes that may arise regarding these Terms of Use, the provisions contained in this text will primarily apply, and in cases where there is no provision, the Laws of the Republic of Turkey will apply.

The parties accept, declare and undertake that in case of disputes that may arise from these Terms, the electronic and system records, commercial records and book records kept by Walkers in its database and servers will constitute conclusive evidence and that this article is an evidentiary contract within the meaning of Article 193 of the Code of Civil Procedure.

FORCE

The agreement, which consists of these Terms of Use and all the terms, published documents and annexes declared on the Site, which are an integral part of them, has been mutually accepted and entered into force at the time the User accesses the Site in any way or uses any information on this website. It is assumed that the User has read and understood these Terms in their entirety at the time of entry into force.
